  1. A roadside blast and mortar attack have been reported on Tuesday in the southern lower Shabelle region, both assaults were claimed by Al-Shabaab militants. The first attack caused by an IED blast has damaged a vehicle belonging to of Africa Union Mission in Somalia (AMISOM) in Arba’ow village near the capital, Mogadishu. The attacked convoy was heading to Mogadishu from the region at the time. AMISOM has not yet commented on the incident. Al-Shabaab fighters also carried out a mortar shelling against AMISOM base in Janaale, located in the same region which has been recaptured by SNA this year after an offensive. The Forum News Service’s Dana Ferguson reports (via the Bemidji Pioneer): “Thousands of Minnesota child care providers will be eligible for federal grant funds to offset the cost of guarding kids and staff against the coronavirus, Gov. Tim Walz announced Tuesday, July 7. … Walz announced that he would put $56.6 million in Coronavirus Aid, Relief and Economic Security Act funds toward grants for child care providers to help them pay for protections against COVID-19, the illness caused by the coronavirus, in the workplace. The measure, which uses the federal funds, needs approval from a panel of legislators before it can become accessible to providers.” Special session starts next week. Also from Ferguson (via the Duluth News Tribune): “Minnesota state lawmakers will return for another special legislative session on Monday, July 13, to weigh an extension of the state’s peacetime emergency to combat the coronavirus, consider a bill to fund public construction projects and potentially compromise on police reform bills. … Gov.   5. Farmers who grow miraa varieties popular with the export market have decried harsh economic times following the suspension of international cargo flights into Somalia amid the Covid-19 pandemic. The farmers from lower lying parts of the Nyambene ranges In Meru County, particularly in Karama, Athiru, Kanjoo among others grow the ‘Grade’ or ‘Kiza’ variety which is exclusively meant for the Somalia market. According to the farmers, the variety is preferred for export due to its succulent trait that enables it to remain fresh after several hours of transportation. The variety is largely grown under irrigation. Led by Nyambene Miraa Sacco Chairman Moses Lichoro, the farmers from Kabuitu in Igembe Central called on President Uhuru Kenyatta to engage his Somalia counterpart Mohamed Abdullahi for the resumption of cargo flights. SAVINGS DEPLETED Mr Lichoro said farmers have run out of their savings after the ban, which is now in the third month, cut off their income. He said since their miraa variety has no market locally, they have been forced to prune their trees and occasionally sell small amounts to local traders. “We have drained our savings and now many farmers cannot afford a meal because we have nowhere to sell our miraa. The situation is dire and the President should move with speed to reopen the economy and engage our neighbours to allow cargo flights,” Mr Lichoro said. He said more than 50 workers were being engaged on his miraa farms daily before Covid-19 shut the economy. “Before the Covid-19 shutdown was declared, I would sell miraa worth more than Sh3 million every month. Over 50 people would earn wages from my farms but many of them are now jobless. Some of them are still relying on me for their daily subsistence. Life is too hard for us,” he said. SALES DOWN Mr Bernard Mwiti, a farmer, said he was making Sh500,000 in miraa sales three months ago but now he can hardly get Sh50,000. Ms Felicity Makena, another farmer, said the closure of the Somalia airspace has had a major negative effect on the economy in miraa growing areas. “We laud the President for the law that recognised miraa as a cash crop. Miraa is the primary source of income in Kabuitu but without a market, we will suffer. The President should move with speed to save the situation,” Ms Makena said. According to Mr Lichoro, Nyambene Miraa Sacco, which has 1,200 members, has hit its lending limit due to increased borrowing from cash-strapped farmers. Somalia closed its airspace and banned cargo flights apart from medical supplies, late March after recording its first Covid-19 case. The trade with Somalia was further complicated by suspension of local flights in the neighbouring country. Early June, the Somali government reportedly revoked the licences of two airlines for smuggling in miraa in the guise of medical supplies, as traders strived to beat the Covid-19 restrictions.   6. After sharks are captured off the coast of Somalia, their meat is salted, sun-dried and transported overland to Kismayo for export to Mombasa, Kenya, the main market in East Africa. Shark fins, on the other hand, are flown to Hong Kong and Singapore, where they are regarded as a delicacy while liver oil from the dwarf gulper shark is exported to Japan via Salalah (Oman) or Dubai. These are just but some of the fishing products from Somalia that find their way to the rest of Africa, the Middle East and Europe. But for all these, the fishing sector generates only $135 million in value per year — or about two per cent of Somalia’s gross domestic product — according to a study by the Heritage Institute for Policy and City University of Mogadishu released at the end of June. “However, it has the potential to be one of the largest and most profitable in the world, considering that the current annual catch represents only a small fraction of the country’s estimated fishery production potential of over 800,000 tonnes per year,” said the study. The problem is that Somalia fisheries is dominated by foreign-owned trawlers. The illegal, unreported and unregulated (IUU) fishing in Somalia’s Exclusive Economic Zone (EEZ) is costing the country more than $300 million each year in lost revenue. “While the fisheries sector is underdeveloped, it nevertheless supports more than 400,000 Somalis who depend on it for their livelihood,” said Dr Kulmiye. The study, funded by the Somalia Stability Fund, set out to assess the status of the fisheries sector; existing skills; and local institutions of higher learning and the quality of their fisheries-related academic programmes, among others. In February last year, a fishing deal signed between the Somalia government and vessels tied to the China Overseas Fisheries Association caused uproar among artisanal fishing community and politicians, who argued that it would destroy their livelihoods. The deal allowed 31 Chinese long line vessels to fish for “tuna and tuna-like species” for one year, but automatically renewed fishing licences for $1,025,750 each year. On June 30, a non-governmental organisation, the Global Fishing Watch, released a report that indicated that roughly 200 Iranian fishing boats operating illegally had been detected in waters off Somalia and Yemen. Also traced were smaller subset of Indian, Pakistani and Sri Lankan flagged vessels. They were traced by the Trygg Mat Tracking, a technology that helps boats avoid collisions, and to identify the boats and their locations. From 1991 when the Somalia state collapsed, it was estimated that between 800 and 1,000 vessels descended on Somali’s EEZ engaging in illegal, unreported and unregulated fishing. Recent studies estimated the foreign catch to be 132,000 tonnes, accounting for 56 per cent of total catches in Somalia’s EEZ. Lack of common legal framework and regulatory regimes as the Somalia Federal Government and some of the federal states follow different laws and rules in managing the sector, is said to enable illegal trawlers to encroach into Somalia’s EEZ. The study finds that bottom trawlers from Egypt, Greece, Italy, Kenya, South Korea, Russia and Thailand operated intermittently in inshore waters under dubious fishing permits issued by different Somali administrations. Local fishermen have accused the trawlers of overfishing, depleting fish stocks, destroying important marine habitats through bottom trawling and disrupting communities’ livelihoods by sweeping away their stationary fishing gear. According to the law, the Ministry of Fisheries is the only entity which can legally issue licences for fishing vessels to operate in the Somali EEZ. But due to lack of the capacity to patrol its territorial waters, the northernmost state of that Puntland and the breakaway Somaliland most of the time offer more protection that Somalia Federal Government. The Ministry of Foreign Affairs (MOFA) on Tuesday reemphasized that Taiwan is not part of China and has every right to pursue relations with other countries, following Beijing’s criticism of the nation’s establishment of ties with Somaliland. “Taiwan is willing to develop cooperation with any democratic and peace-loving countries under the spirit of mutual benefit and reciprocity. China’s criticism of Taiwan is not needed,” MOFA spokeswoman Joanne Ou said during a regular press briefing. Ou was responding to media questions following criticism by the government of Somalia, which considers Somaliland part of its territory, and by China, which views Taiwan in the same way. Somalia’s presidential office, in a statement issued on July 4, said President Mohamed Abdullahi Farmajo denounced “Taiwan’s violation of the sovereignty and territorial integrity of Somalia.” Meanwhile, Chinese foreign ministry spokesman Zhao Lijian said Monday during a press briefing in Beijing that China objects to the exchange of representative offices between Taiwan and Somaliland, and described Taiwan’s move as an attempt to promote secessionism. “MOFA condemns the Chinese government’s disparagement of the sovereignty of Republic of China (Taiwan),” Ou said, reiterating that Taiwan is not part of China. Taiwan will continue to further conduct “pragmatic diplomacy” and welcome any development of substantive relationships with like-minded countries, she added. However, Ou did not directly respond to the accusations made by the Somalia government in her statement. Somaliland, situated in East Africa, declared independence in 1991 after a civil war in Somalia. Although it is not recognized as a country by the international community, several countries and international organizations, including the United Nations, maintain offices there.   10. On July 7, Abdiaziz Ahmed Gurbiye, the chief editor and deputy director of the independent Goobjoog Media Group, appeared in court in Somalia’s capital, Mogadishu. But his case should have never gone this far. On April 14, Abdiaziz was summoned to his local police station and detained for four days after making two Facebook posts criticizing the Somali government’s response to the Covid-19 pandemic. The authorities released Abdiaziz on bail, but warned him against pursuing any further critical commentary, including on Covid-19. He’s been living in legal limbo ever since. But last week, Mogadishu’s regional court summoned Abdiaziz on charges of “insult[ing] a political, administrative or judicial body,” and “publication of false news.” These vague offenses are found in outdated provisions restricting free expression in the country’s criminal code. The charges violate Somalia’s obligations under regional and international human rights treaties that protect people’s right to criticize government officials and state institutions. As the African Commission on Human and Peoples’ Rights has stated, those “who assume highly visible public roles must necessarily face a higher degree of criticism than private citizens; otherwise public debate may be stifled altogether.” On World Press Freedom Day in May, Somalia’s President Mohamed Abdullahi Mohamed “Farmajo” publicly committed to reforming outdated provisions in the country’s criminal code. He also said his administration supported ending the use of criminal law against journalists. While steps have yet to be taken to reform the criminal code, the government can immediately improve Somalia’s media environment by not bringing criminal cases against journalists for doing their jobs. It’s not too late in Abdiaziz’s case. Authorities should immediately drop the charges against Abdiaziz and make clear that critical commentary is a welcome element of democratic society. The Fedaration of the Somali Journalists (FESOJ) upholds the legal decision by defending lawyers of journalist Abdiziz Ahmed Gurbiye, the editor of the Goobjoog Media Group who appeared in Benadir Regional court on Tuesday July 7, 2020 after the Attorney General’s office started press charges under Somalia’s archaic criminal law despite the recent declaration by president Mohamed Abdullahi Farmajo’s recent affirmations of reforms in provisions in the country’s penal code to ensure it is not used against journlists . The opening speech of the trial by the ruling judge handling the journalist’s case Tuesday have met with protests by the defening lawyers of the journalist who challenged the judge’s attempts to proceed the trial under the controversial law insisting that the court had no legal jurisdioctions to proceed with the case under the outdated law hence filing for an objection . The legal defense team of Abdiaziz Gurbiye also filed an application seeking the court to drop the case against the journalist altogether as the alleged articles to be evoked for the case violate the article 18 of the Somali constitution, which guarantees freedom of speech and the media. During the brief trial, the lawyers also contested that Abdiaziz Ahmed Gurbiye is a professional journalist who was carrying out his press duties and that his conviction could not totally be referred on criminal law under Somalia’s Penal Code. The state prosecutor Yahye Mohamed Said who filed the charges against the journalist at the court also insisted the presiding judge that the journalist violated articles of 269 and 328 of the Somali Penal Code with charges of insult of judicial body and publication of ‘false’ news, therefore challenging the court it had full jurisdiction to proceed with the case and proscute journalist Abdiaziz Ahmed Gurbiye and demanded the trail to be finalized . The judge has adjourned the case, saying that the magistrate court would advise about the way forward for the journalist’s case. Fellow journalists, the Secretary General of FESOJ ,Goobjoog Director and members from the civil society organized were among the people allowed to hear the case of Abdiaziz Ahmed Gurbiye who is a member of FESOJ. “We urge the court to dismiss these charges against Abdiaziz Ahmed Gurbiye because, from the legal viewpoint, the case is completely inadmissible,” Mohamed Ibrahim Moalimuu the Secretraty general of FESOJ told journalists at a press release after the the adjournment of the trial was announced. “It is unfortunate that journalists are still being prosecuted under the draconian Somali Penal Code which is an outdated and contradicts the Provisional Somali Constitution — therefore, we call on the Attorney General’s office and the country’s authorities to abandon it and to decriminalize journalists under the Penal Code. Defending lawyers of the journalists Dahir Mohamed Ali and Ahmed Abdirahman Diriye said they are committed to defend the journalist in front of the law until they ensure his freedom and that all allegations against journalists are unfounded and put forward an objection .
