Germany immigration last week splashed Sh15.6 million (€137,000) to deport two Kenyans using a charted jet. Early Thursday morning, a Bavarian police car drove into the Berlin-Schönefeld airport carrying 48-year-old Kenyan man ready for deportation. DEPORTATION On board of the chartered “Bombardier Global Express” private jet, was another Kenyan man also being deported by the state of Baden-Wurttemberg after his asylum application was rejected with no possibility of appealing the decision. The news of the amount of money spent in the deportation of the two Kenyans however did not go down well with Germans after it was feature on ARD’s magazine Report München. According to Mkenya Ujerumani, a local blog about Kenyans in Germany, the case has caused outrage, not because of the deportation, but because of the cost of it. The quoted expenditure did not include that of the 14 person team which escorted the two men. The uneventful exercise took less than 36 hours to deliver the two men to Nairobi and have the team return to Berlin. EXTRAVAGANCE In addition to the flight crew, there were nine federal police officers, a medical doctor, a paramedic and a representative of the border protection agency Frontex – as neutral observer to document whether or not the officials followed proper deportation procedure. However, Baden-Württemberg and Bavaria, the states that chartered the private jet, have attempted to explain the extravagance. They said a commercial flight was out of question because the two had been issued with emergency travel documents by the Kenyan government that were only valid for 3 days. “Finding seats for the two and the 10 plus escort team and the risk of the flight being grounded if the two men resisted the exercise, ruled out a commercial flight in such a short time period,” an expert explained on Report München. The officials also claimed the two had been labelled dangerous delinquents. ASSAULT CHARGES However, no evidence was put forward to support the claim in regards to the man from Baden-Württemberg. The unnamed 48-year-old has been living in Germany for the past 20 years and has had several encounters with the police in Bavaria. After his last encounter, the Bavarian State Office for Asylum and Repatriation (Bayerische Landesamt für Asyl und Rückführung) ordered for immediate deportation after serving his sentence. Among the charges levelled against him included, assault, theft, insult and obstruction of law enforcement. In the last incident, he was charged with attempted murder, after he reportedly beat up the victim so badly that the victim lost 80 percent of his sight and has had to undergo three surgeries. In 2016, when Puntland State signed up to the 2017 enhanced elections on the basis of the 4.5 power-sharing mechanism, an unenforceable but widely accepted principle lay at the heart of the deal: In 2021, one person, one vote elections will replace the infamous 4.5. power-sharing system. In a tweet, the former Special Representative for Secretary General, Michael Keating, urged Somali leaders to start planning for 2021 elections. Nearly two years after the second post-transition election, Somalia faces three obstacles to enabling Somalis to exercise their suffrage rights. Flip-flopping Electoral Commission The first obstacle stems from contradictory statements of the National Independent Electoral Commission. Earlier, in 2019, the Chairwoman of the NIEC, Halima Ismail Ibrahim, held a press conference in Mogadishu to drive home the message that one person, one vote elections would not take place in Somalia in 2021. Halima was responding to political party pressures exerted on the Federal Government. Political parties urged the Federal Government of Somalia to publish electoral plans. Two former presidents had registered their parties with the Commission, whereas in February, a former presidential candidate, Abdirahman Abdishakur, opened an office for his party in Garowe, the administrative capital of Puntland. “There are signs that one person, one vote elections will not take place in Somalia in 2021 under the current political circumstances. Political parties have begun to campaign too early. Somalia has adopted federalism, but a federal government cannot reply upon MPs selected by traditional leaders,” Halima told media representatives. Five months after that statement, the NIEC Chairwoman held a meeting with two-part leaders that had received temporary registration certificates. While NIEC’s assessment made in March 2019 seemed more realistic, subsequent declarations about planned elections run counter to political realities in Somalia. NIEC has had consultative meetings with stakeholders in Puntland about how elections will be conducted in Somalia for the first time since 1969, when Somalia conducted one person, one vote elections for a democratically elected government later overthrown by the military. “Clannish” Political Parties Most political parties that registered with NIEC are based in Mogadishu. Somali parties have not developed political programmes, nor have they operated as political associations to field-test their ideas in a country that has lived through 9 years of statelessness, twelve years of transition, and is going through the seventh year of the post-transition era, which has a lot in common with the transitional period. Some of the political parties are popularly known for their appellations, such as Aala Sheikh (led by the former President of the Transitional Federal Government, Sharif Sheikh Ahmed,) and Damul-jadiid (led by the first post-transition President, Hassan Sheikh Mohamud). Unresolved Territorial Disputes The most glaring impediment to one person, one vote revolves around the territorial dispute between Puntland and Somaliland. Puntland State is a full member of the Federal Government of Somalia. Somaliland has representatives in the federal institutions, MPS, and Senators selected in Mogadishu, but the Hargeisa-based administration claiming to have seceded from Somalia in 1991 does not recognise the Federal Government of Somalia. Federal Government ministers and officials risk arrest if they visit areas under the control of Somaliland administration. Somaliland Administration conducted elections in parts of the disputed territories that Puntland represents federally in 2010 and 2017. In 2016, The Federal Government of Somalia signed an agreement that entitles Puntland to represent disputed territories at the federal level. Doha: The Ministry of Interior (MoI) and the Ministry of Administrative Development, Labor and Social Affairs (MADLSA) have announced a number of measures on work and residence permits to be implemented soon. The measures include allowing the sons of residents to work in the private sector without changing their sponsorship. New decisions also include granting new visa for temporary work in some professions and jobs and reducing the fees by 20 percent for MoI’s services, which are delivered electronically. These measures were announced at a press conference attended by Director General of the Department of Passports Brigadier Mohammed Ahmed Al Ateeq, Assistant Undersecretary for Labor Affairs of the MADLSA Mohammed Hassan Al Obaidli and Assistant Director of Legal Affairs at MoI Lt. Col. Ahmed Abdullah Al Harami. Official explained that for a family member of an expat to work in Qatar without changing sponsorship they will have to get a written approval from the head of the family and obtain a work permit from the ministry after paying required fees. As per the proposal, these visas will be issued by MoI after the approval by the MADLSA while all required procedures will be carried out through Qatar Visa Centres abroad or soon they arrive in the country. Temporary work visas valid for one month will be charged QR 300 and for two months QR 500. Visas valid from 3 to 6 months will be charged 200 for each month. Brigadier Al Ateeq said that these measures were based on Qatar’s intention to utilize the capabilities of sons of expatriate residents in the country. He added that work is underway to develop a legislative tool for this proposal through the amendment of the provision of Article No. 17 of Law No. 21 of 2015 so that it allows all members of an expatriate family to work with any employer in the private sector without being obliged to transfer their residence. As per the current system, only daughters are allowed to work without changing sponsorship. As per the new proposal, all members of the family will be allowed to work without changing their family sponsorship. On the introduction of a new temporary work visa in certain professions and jobs, Al Ateeq said that these visas will be granted to private companies, commercial establishments and other licensed entities in the country to perform some emergency, temporary or seasonal work that requires the workforce for a specific period, season or occasion. Regarding the proposal to reduce fees for services rendered and completed electronically, the Director General of the Department of Passports said that this comes within the framework of Ministry of Interior’s policy of facilitating procedures and providing services to beneficiaries in the best way possible in order to achieve the goal of “ministry without paper” through electronic systems and high quality automated programs such as the e-government system, the MoI’s website and Metrash 2 for submitting and completing applications to obtain the required services with minimal effort and less time. During the press conference, Director General of Passports announced the proposal to introduce a new temporary work visa system for some professions and jobs in order to accommodate the need of the labor market and create a suitable environment for domestic and foreign investment. For his part, Assistant Undersecretary for Labor Affairs of the MADLSA Mohammed Hassan Al Obaidli pointed out that there are a number of advantages in the proposal to allow the sons of residents to work in the private sector without having to transfer their residency, which will reflect positively on the labor market and on all categories of the Qatari society both citizens and residents, and meet Qatar’s national vision and development strategies. He pointed out that the new proposal will reduce recruitment of marginal labor surplus than required by the labor market, reducing the costs of recruitment and housing expenses for the employer, take advantage of the their familiarity with the customs and traditions of the Qatari society, in addition to the possibility of utilizing their qualifications and competencies to work temporarily or permanently under internal employment contracts in private companies. “This will also help to eliminate leisure time for this category, which is often exploited in unhelpful aspects,” he added. Al Obaidli said among conditions for allowing family members to work in accordance with the current proposal will be a written approval by the head of the family and obtaining a work permit from the competent authority at the Ministry of Administrative Development, Labor and Social Affairs after paying the required fees. With regard to the issuance of temporary work visas to accommodate the need of the labor market in some professions and facilitate and diversify recruitment for employers and companies, Al Obaidli explained that the proposal has been studied with a view to creating a suitable environment for domestic and foreign investment; and there was also coordination between the concerned authorities in the Ministry of Interior, and the Ministry of Administrative Development, Labor and Social Affairs and the relevant authorities, upon which it was agreed to put in place guidelines, conditions and requirements of this visa, and determine the duration and fees. Al Obaidli said that the issuance of the proposed visa will only be considered by the competent authorities when the competent department at the Ministry of Administrative Development, Labor and Social Affairs confirms the existence of a (temporary) employment contract between the worker and the employer in accordance with what is needed in such cases, and in line with the provisions of the Labor Law No. 14 of the year 2004 and its amendments and the resolutions implementing it. He pointed out that the contract will be reviewed and approved in a manner that does not contravene an offer of work submitted to the worker, as well as passing the necessary medical examination through the Qatar visa centers abroad, noting that in case of the absence of those centers in the country of the worker, the worker is required to take these procedures immediately on entering the country, in the same way as other categories of expatriate labor do according to the applicable procedures in this regard. In turn, Assistant Director of Legal Affairs at MoI Lt. Col. Ahmed Abdullah Al Harami asserted that these proposals have been studied and completed and work is underway to develop a legal tool and legislative procedures to finalize it and then complete the procedures for their application.
