If so, you would have known that if provisions of an article are not implemented, the rest of the article becomes untenable, and therefore in a pending status. And yes to discussions, but by people who understand its inner workings, and can engage in intelligable dialogue.

A bit simplistic as there is no timeline for implementing the provisions. Also, there are no provisions stating the creation of a state admin could happen before 49 (2) (granted there is nothing stopping it from happening either).

 

Are you saying that because an admin has been created those articles are now null and void?

Xiin, how will Jubbaland receive parliamentary approval?

^^honestly I don't know all the details ---I believe no one does at this point. The constitution provides general legal framework for the creation of federal states. If there is no border dispute , the process of approving a federal state is very straight forward . If there are border disputes , then a commission will be required, and it could take time.

 

In Jubbaland's case, since the three regions are very well defined, we don't anticipate any border disputes.

If the Parlaiment takes up the motion regarding to Juba Federal State (JFS) then the approval will follow its normal parlaimentary procedure course. Simple majority will decide if creation of federal member state of JFS is in accordance with the constitution.

 

NORF bro the system and the institutions that support it are work in progress. They are not fully developed. That being the case there are several senerios:

 

If the Parlaiment does not take the issue up, the JFS is constitutional by default.

 

The opposition could take its grievances to the Constititional Court. As you may know two critical institutions have yet to be established -- House of Elders or the Upper House and Constitutional Court.

 

Also parliamentary procedure that governs meetings of legislative bodies is yet to be developed. The machinary of the state needs a lot of oolyo garaaso as they say in Xamar :)

 

However you look the JLS case, the center managed this issues very poorly and today the political momentum is with JFS

This whole situation has been extremely badly mishandled by the President. It will be interesting to see what happens now in the Parliament since Mr Jawaari has been completely silent regarding this issue.

I agree. I think the government has been on the back foot all along not knowing what to do and which way to go. Its all been reactionary. They have had ample time to progress the implementation of the required constitutional framework (even if only on paper). One can't say they haven't had a reasonable amount of time. It has got to the stage where Jubbaland holds all the cards (and good on them).

You raised valid points, but unless the federal parliament gets its act together, creates the required federal commission, and unless the Federal member States House [upper house] has been created (which could not without the formation of federal member state which shall be members of that Upper house - prerequisite), it can hardly get involved in the process, and anything the federal MPs do, short of supporting the process, will lack legitimacy, and cause further confusion.
