The decision on Thursday to take proceedings to the next stage is a setback for the Foreign Office which had argued that the British government should not be held liable because legal responsibility has passed on to the present Kenyan government. It also opens the debate over the possibility of additional landmark lawsuits against Britain and other European nations for abuses during the colonial era, one of the Kenyans’ attorneys said. Al Jazeera’s Nadim Baba said the main aim of the case was “moral and not financial” and that much was yet to be decided about the next step in the legal process. “There is some wariness from the claimants about the delays that could come before a trial. The Foreign Office is expected to raise issues of limitations, saying too much time has elapsed,” said Baba from outside the High Court in London on Thursday. “If the case is allowed to go to full trial, we’re looking at sometime in early 2012,” he added. “] Kenyans say they were beaten and sexually assaulted by officers acting for the UK government [GETTY Long-ago abuses Despite the potential delays, several Mau Mau supporters present in the court room in London told Reuters the judgment was a “great day for Kenya”. “It’s so far so good but we’re hoping that things get better and the right decision will be made in favour of the survivors,” said Sammy Kimetu, originally from Kenya. Richard McCombe, the high court judge, ruled on Thursday that the claimants “have arguable cases in law”, and that the suit can go ahead. But he added: “I have not found that there was systematic torture nor, if there was, the UK government is liable.” The British government had tried to have the case thrown out, saying it could not be held legally responsible for the long-ago abuses. It argues that legal responsibility was transferred to the Kenyan Republic when it became independent in 1963. Its counsel, Robert Jay, had argued that the case was “built on inference” and ended in a “cul-de-sac”, the Press Association reported. But Al Jazeera’s Baba said the ruling was a “cause for cautious optimism”. “The [claimants] are confident they will get compensation and an apology from the British government,” he said. The plaintiffs, Ndiku Mutwiwa Mutua, Paulo Muoka Nzili, Wambugu Wa Nyingi and Jane Muthoni Mara, who are in their 70s and 80 – flew more than 6,400 kilometres from their rural homes for the trial earlier this year. The abuses in question were allegedly committed in British detention camps between 1952 and 1961. The Kenyans say they were beaten and sexually assaulted by officers acting for the British administration who were trying to suppress the rebellion against the British officials and white farmers who had settled in some of Kenya’s most fertile lands. They say British administrators were aware they were being mistreated, and want an apology and compensation. They were not in court for Thursday’s judgment. ‘Open a can of worms’ At the earlier hearing, the judge was told that Mutua and Nzili had been castrated while Nyingi was beaten unconscious in an incident in which 11 men were clubbed to death. Mara had been subjected to sexual abuse, the judge heard. Historians estimate as many as 150,000 suspected members of the Mau Mau, a resistance movement launched by Kenyan tribes, were detained without trial between 1952 and 1961 and placed in British-administered camps. The decision to take proceedings to the next stage is a setback for the Foreign Office which had argued that the British government should not be held liable as legal responsibility has devolved on to the present Kenyan government. Next Easter, another hearing will be held to assess the evidence before any decision is made on whether to proceed to a full trial. If the test-case claimants are eventually successful, more similar cases seeking substantial damages could be brought against the British government. Welcoming the decision, Martyn Day who represents the Kenyan survivors said the British government could “open a can of worms” if an eventual judgment is made against them. “Undoubtedly the government is worried about the impact and implication of a judgment of this sort being made against them,” he told Reuters. “It would be much more sensible for the government to sit around the table and talk to us rather than potentially face massive trouble from colonial groups around the world.”

The Book fair will last for four days as planned by the organizing committee. The event was attended by high profile figures including government officials, poets, writers, composers and readers clubs from the regions of the country. Faisal Ali Warabe as the chairman of opposition party, Muuse Biihi, the chairman of ruling party, Hadrawi as a poet, Boobe yusuf Duale as writer and other guests attended the ceremony. The minister for sports, culture and youth officially opened the event. The event which was highly organized went under way as a schedule and Jama Muse Jama who is one of the leading organizers delivered a speech by which he demanded the government to establish Public library where people come and enjoy reading books. The event was held in Freedom Park and writers from home and abroad displays their newly published books and participants were encouraged to buy these books. Hadrawi who is a prolific poet spoke and he talked about what is going to happen with in the coming days. There will be s poetry contest and the youth is to take a leading role. There were guests invited from Garowe and Djibouti who attended the event. Finally, the ceremony was well organized where all those invited enjoyed the cultural festival which was held in their country.

The cause of the blast was unknown but the tangled wreckage of a car was outside one building. And an Associated Press reporter said newspaper offices in the area were also damaged and smoke could be seen drifting in the streets. The reporter said he saw a young man with a bleeding leg being helped away from the area. It was not immediately clear whether there were other injuries. The attack comes days after Norwegian prosecutors filed a terrorism charge against Mullah Krekar, founder of the Kurdish Islamist group Ansar al-Islam, who is accused of threatening a former minister, Erna Solberg, with death. "Norway will pay a heavy price for my death," he said. "If, for example, Erna Solberg deports me and I die as a result, she will suffer the same fate." African viewpoint: Messy divorces In our series of viewpoints from African journalists, Ghanaian writer and opposition politician Elizabeth Ohene says that that the break-up of a political marriage is as painful as a real-life divorce. A former first lady of Ghana lost an election most emphatically on 9 July, the same day that the new Republic of South Sudan was born. While the events in Juba, the capital of South Sudan, were a joyful affair, the events in Sunyani, the capital of Ghana's Brong Ahafo Region, were very painful to watch. Nana Konadu Agyeman Rawlings, wife of former President Jerry Rawlings, was contesting an election to become the presidential candidate of the governing National Democratic Congress (NDC) party in polls due next year. Her opponent was President John Atta Mills, who was Mr Rawlings' protege and had come to power in 2009 with the firm backing of the Rawlings. Whereas in all cultures we have devised elaborate rites for marriages, the process of breaking up remains mostly unstructured and messy. The problem often is that it is very rare for both sides in a relationship to conclude at the same time that a marriage has broken down irretrievably. The African Union (AU), like the Catholic Church, is resolutely against divorce. What god (or in Africa's case, the colonial powers) has put together, cannot and should not be put asunder. 'Marital property' The African map, as drawn by the colonial powers, is sacrosanct - no matter how absurd. The AU, though, reluctantly endorsed South Sudan's independence. As I watched the birth of the nation and the joy on the faces of the crowds in Juba, I looked at at the face of Omar al-Bashir, now president of a half Sudan. I could tell he was hurting. Maybe, it had something to do with the sharing of the marital property and the oil revenue going to the south. South Sudan won independence after decades of conflict with the north The problem is that even pre-nuptial agreements never bring equal solace to both sides. Then, my mind went to a May dawn in 1994 in Pretoria at the inauguration of a certain Nelson Mandela. Not exactly a divorce that one, but not quite a marriage either since this "new" South Africa did not require a new domain name or a new football team as South Sudan apparently does - but it did get a new flag and a new national anthem. That, too, was a relationship among different races that had collapsed and was being re-engineered after years of trouble. We all wished them well and have been watching their progress sometimes with anxiety but more often with a lot of pride. 'Delirious' A year ago they did Africa proud by hosting a successful football World Cup tournament and one got the impression this new marriage was working even if the partners were still adjusting to the shift in power. My mind then went to a country much nearer to the new state of South Sudan - Eritrea. It divorced from Ethiopia in 1993 after a long liberation war. Like the crowds in Juba on 9 July, the Eritreans were delirious at nationhood but the divorce was traumatic for Ethiopians. The sharing of the spoils had turned Ethiopia into a landlocked nation overnight, as the country's only port fell in Eritrea. Somaliland's independence has not been recognised by any other country But an even more interesting example is that of Somaliland, which broke away from Somalia 20 years ago. That divorce has not been recognized by officialdom but Somaliland has certainly left the marriage and we wait for the formalities to be concluded one day. Which all brings me back to events in Sunyani. The fall-out between the Rawlings and their one-time protege - Mr Atta Mills - was played out in full glare of the public. It seemed to me this was a classic case of an abusive relationship where the marriage had broken down but one side was still trying to hold on to it. I have not quite worked out who filed for divorce, but the truth is that the marriage is over. Mr Atta Mills has spoken about working for unity, but that is just empty talk. This was a divorce and we await the sharing of the spoils.
