Confusing' articles in Somalia draft constitution 12 May 12, 2012 - 9:34:58 AM GAROWE, Somalia May 12 2012 (Garowe Online) - On Friday the Puntland government said that a number of articles in the Somalia draft constitution were "confusing and contradictory", Garowe Online was able to attain some of the articles in question. In a press release on Friday, the Puntland government said a six member review committee reviewed the Somalia draft constitution and concluded that it was designed for a highly centralized government and some articles in the constitution need to be amended. Furthermore the Puntland government said that the Somalia draft constitution should not be presented to the National Constituent Assembly (NCA), until changes are made and agreed upon by Somali stakeholders. Here are some articles that the Puntland government wanted amended: Article 45 (Natural Resources) says, “The Federal Parliament shall legislate laws governing the sharing of natural resources, such as hydrocarbons, minerals and issuance of fishing permits between the Federal Government, Member States and District Administrations.” The Puntland government stated that this article violated the federal system and requested this article be removed until member states negotiate on the issue of natural resources. Officials in Puntland say before a constitution could be signed articles like these need to be clarified. Another article in question was the Number of People's Assembly article 88: “A specific law shall define the procedure to come up with the final number of members of the People’s Assembly.” This article breaks the previous agreements signed in Garowe and Mogadishu which sets the number of the People's Assembly, also called the Lower House, to 225 MPs. In the Somalia draft constitution paragraph 2, in article 113 says, that a presidential candidate must relinquish his foreign nationality prior to standing election. Over 20 years of civil war in Somalia has forced many Somalis to flee their native land and live as Diaspora. Analysts say that a large amount of Diaspora are involved in Somali politics and hold key positions. The Puntland government requested the removal of that paragraph. The Somalia draft constitution according to analysts who spoke to Garowe Online was rushed to meet a deadline. The TFG's executive branch were working on the constitution for 8 months after the initial draft along with a Committee of Experts (CoE) and the Independent Federal Constitution Commission (IFCC). The Somalia draft constitution has been presented to audiences in Minnesota and Ohio. However limited consultations to Somalis both in Somalia and out, weak attendance and a time squeeze failed to garner the discussions warranted to make the consultation process legitimate. According to the Wardheernews agency, "A committee appointed to visit cities with large Somali populations, and hold consultative meetings to get feedback on the Somalia draft constitution, failed to publicize those meetings and did not receive much turnout." Although the TFG held consultation meetings and told participatory groups that the draft constitution has the potential to evolve, but there is an article that restricts amendments for a period of 7 years after the NCA votes to adopt the constitution. A local source says a total of 10 pages of changes and removals were submitted to the TFG. The TFG have been adamant that opposition to the Somalia draft constitution will not be tolerated but the Puntland government says serious lack of clarity and contradictory articles have forced the Puntland government to act now. The ratification will happen on Tuesday, a postponement doesn't make sense to a date after it's ratified, I think they realised there's no point. The issue will now be which articles should be amended as it should have been from the get go. -

Sheikh Bashir Salad , the chairman of the Council of Religious Scholars of Somalia, has issued a statement criticising the content of and the process for legitimising the international community-funded and controlled draft-constitution of Somalia. He has called for openness and transparency in the constitution-making process and demanded that Somalia's religious scholars be consulted. Who are they, where were they in the past 21 years and what right do they have now to demand and be consulted with? Is he not the one that condemned the TFG doing Abdullahi Yusuf but then condemned Al-Shabaab and sided with Shariif even though Shariif sided with the Ethiopians? They can shove it, they have no business involving themselves in politics, culuma my butt .

You are getting carried away, do not blame others for your lack of political ambitions. So much jealousy, no one works for Ethiopia, Ethiopia has no one's interests at heart, people work for their own interests.

SPARED the violence that has ravaged southern Somalia for two decades, the breakaway Somaliland and Puntland regions are investing in education to lure youngsters away from extremism and piracy. The self-proclaimed Republic of Somaliland hopes to prove it can build a stable, independent state as the international community has not recognised its autonomy since it split away from Somalia in 1991. Semi-autonomous Puntland to the east - created in 1998 and now boasting its own political institutions and administration - is striving to keep its youth from joining Islamist extremist or pirate groups. "Several generations have been lost, first under the (Somalia ex-president Mohamed Siad) Barre regime and then during the civil war," Puntland's president, Abdirahman Mohamud Farole, recently told an EU delegation. The European Union, Somalia's biggest donor, contributes 85 million euros ($110 million) a year to the education sector in the whole of Somalia, including the two breakaway regions. "We're against radical Islamism," Farole said. Somalia's Al Qaeda-linked Shebab insurgents, under military pressure in the centre and south of the country, are reportedly trying to establish bases in Puntland, where the area's first pirate gangs emerged in 1998. Zamzam Abdi Adan, Somaliland's education minister, estimated that only 50 to 55 percent of children in the region attend school. "A nation can only be strong when it has human resources," Adan, a former teacher and Somaliland's only woman minister, told AFP. "We're trying to build solid human resources." "We try to convince parents to send their children to school," said Adan, who in 2011 made primary education free and started to integrate teachers - previously paid by school fees - into the civil service. This year the state will allocate 10 per cent of its budget to education. Neighbouring Puntland plans to allocate 3.5 per cent of its budget to education this year, and 7 per cent in 2013. "Education is the only way of counterbalancing extremism in Somalia. It's important to... provide a future" for young people," said Puntland's Education Minister Abdi Farah Said Juxa. "Without education there is no hope," he said, adding that the other options young people face are piracy and other criminal activities. EU education support "helps prevent a situation where young people with no qualifications get involved in extremist activities," said Isabel Faria de Almeida, who heads the EU's Education and Economic Development unit for Somalia. The program also aims to get more girls into school, particularly into secondary school, where there are fewer girls despite an increase in overall enrollment. Despite all their efforts and support from the EU, which pays some teachers' salaries on top of other support, the two regions are facing a huge challenge. "Classes are full to overflowing and there aren't enough tables," explained Nassir Jam Bulale, the headmaster of the Fadumo Bihi school in Hargeisa, the capital of Somaliland, where four children squash onto a bench intended for two. For colleague Ali Ahmed Balayah, one of the problems is low pay for state school teachers who earn around $100 dollars a month. Once they get some experience, many of them flock to private schools, where they can earn up to three times more. Puntland's Education Minister says that teacher training is a priority in his region. "We need more classrooms, more teachers... more water, more electricity, more everything," his Somaliland counterpart said.

There's a bigger picture at play. Ethiopians supported by the state department was solely so the ICU could be defeated, Ethiopia had no plans to stabilise the country, even Abdullahi Yusuf knew this, and his purpose was for the TFG to continue even after him as the sole government in Somalia, reason being the formation of ICU would be bad for Somalia not in the next 10 years, but the next 50 years and it would destroy the possibility of federalism and Somalia's role with its neighbours and the international community. Also, Samatar I just don't like him and his pompous opportunistic ways. As for Khalif Galayr, the man is a born loser, he is not threat to federalism, Puntland or let alone the upcoming Cayn State of Somalia. But your comment about Sheikh Shariif is interesting, the man is a politician after all as he flashed us his balls when talking about Farmaajo, then we realised that this man is a hustler from the streets of Xamar. So I believe that he won't go against the federal system, not only because because his clan might get the capital as a state but also because he knows it will go through nor matter what he does, the international community is watching on this one. How weak the federal government will be will depend on who rules it come August, so we will wait till August to see who wins the game.
