A Somali tycoon is charged in Nairobi.

 

Somali businessman who is believed to be the financier of the Islamic court Union appeared today in a Makadara court for being unlawfully present in the country and failing to register as an alien.

 

The wheeled tycoon Abukar Omar Adan was charged alongside his son Omar Abubakar Omar after being in police custody for one month. On a wheel chair Abukar Omar Aden was escorted to the court, where he was charged for unlawfully being in Kenya.

 

A room had to be created for the wheeled tycoon so that he could face the charges while in a relaxed atmosphere.

 

Also in court to face similar charges was his son Omar Abubakar Omar. But just after the matter was mentioned, their lawyer James Orengo raised a preliminary objection saying his clients were a subject to a proceeding at the high court and the entire process of charging them at the lower court was an abuse of the court process.

 

He asked Makadara Chief Magistrate Margaret Wachira to refer the matter to the high court where a constitutional issue concerning the two has not been determined.

 

Orengo told the court that his clients were not illegal immigrants as stated in the charge sheet but had come to the country for fear of their lives.

 

He said that his clients did not come into the country as economic refugees but as people who seriously needed the government protection because their lives had been threatened back in Somali.

 

The court ordered that Aden to be taken to Kenyatta National Hospital for special treatment. Orengo will continue to argue his application on Monday.

 

Meanwhile, The High Court in Nairobi has stopped the City Council from demolishing buildings and structures in a contested parcel of land at Milimani area off State House Road.

 

Justice Roslyn Wendo also quashed an enforcement the council issued on January 19 that paved the way for demolition.

 

Lawyer Kibe Mungai told Justice Wendo that the land in contention belongs to Margarate Wanjiru Gachuhi who is mentally handicapped and currently bedridden in one of the structures targeted for demolition.

 

Kibe told the court that Isaac Wanjohi who claims to have bought the land from Wanjiru is engineering the demolition through the back door.

 

Wanjiru claims to have acquired the land in 1968 and is accusing Wanjohi for infringing the Physical Planning Act that requires an expiry of 30 days after a notice is served.

 

The tenants currently at the plot repulsed the City Council demolition squad when they had done almost 70 percent of demolition where property estimated at 30 million shillings was destroyed.

Wealthy Islamist pleads guilty in Kenya

Nairobi - A wealthy businessman who financed Somalia's ousted Islamic movement pleaded guilty Thursday to being in Kenya illegally, but his attorney argued he shouldn't be deported because he was fleeing for his life.

 

Abukar Omar Aden, 72, was charged along with his son, Omar Abukar Omar, who was a finance official for the Council of Islamic Courts. The son said he had a visa for Kenya and denied being here illegally. The two were arrested earlier this month as they tried to cross into Kenya after the Somali movement was driven from the capital and much of the country's south.

 

"Your honor, these people should have been given the protection of the law," defense attorney James Orengo said. "They are here because of a life-threatening situation, they were running for their lives."

 

Aden, who was paralysed in a car accident in 2002 and is confined to a wheelchair, has acknowledged providing the radical Islamic group with money and other goods, and is believed to have been a major source of funding for the movement. He covered his face from photographers and spat at reporters as he entered the courthouse in Nairobi.

 

The United States has accused the Islamic group of ties to al-Qaeda, but Aden has never been linked to terrorists.

 

The men are scheduled to appear in court again on Monday. Their attorney said he will argue his clients' constitutional rights have been violated.

 

Born in Mogadishu, Aden is a well-known commodities trader, dealing in sugar, cosmetics and luxury cars. He also once controlled the El-Maan port in the Somali capital and owned

Mogadishu's Ramadan Hotel, where Islamic leaders held their meetings.

 

Somalia, a Horn of Africa nation of more than seven million people, is struggling to emerge from more than a decade of chaos. In 1991, warlords toppled dictator Mohamed Siad Barre and turned on each other, plunging the country into anarchy.

 

The Islamic courts seized control of the capital and much of the south six months ago, bringing a semblance of stability but terrifying residents with threats of public executions and floggings of criminals. Some businessmen backed them, welcoming the order they brought.

 

Somali troops, backed by the Ethiopian military, routed the Islamic militia late last month and allowed Somalia's UN-backed government to enter the capital for the first time since it was established in 2004. Most Islamic militiamen have dispersed or are in hiding. -

Well Sheikh Sharif was the head of the ICU and is considerably useful in trying to help quell some of the Mogadishu unrest. Also, my belief is the Americans are intent to divulge much secrets from him about the ICU.

^^^Indeed, I guess they have already questioned Adaan. Note one thing nothing has changed from the Americans, they want to talk to him but their course is still the same as before. They are funding the AU deployment, and bombing the hell out of the remainder in the south.

I feel sad for the old man. He should be let back into Xamar and his accounts frozen and he should get a monthly stipend from his accounts so as not to fund any major organizations like the ICU again.

^ No sxb. But do you want cumar abukar cadani puting fear in the heart of Barre Hiraale when his sons thru him were collecting Kismaayos port and airport revenue again?

 

He has two options. Retire from his funding quests of the The ICU or die in some Kenyan jail a really old man. I think he would choose the former even with strings attached.

Jenerale, waa runtaa. La jiifiyaa banaan seems to be the policy here. Shariif can help the TFG stand on its feet but this old maskiin man?? I don't know faa'iidada ugu jirta if they let this old man go? How many legal & illegal immigrants end up in Kenyan jails everynight and pay their way out in the morning?

Let the old man be free! you know sh1t happens and on the other hand it is not tfg's best interest ti keep him in jail. So lets forgive and start fresh.
