  3. which is different from copyright. copyright deals with a creative work of authorship such as a book, play etc. trademarks deals with company logos, names, and short phrases e.g "Just do it" for nike is trademark. but the trouble with trademarks is that to enforce your trademark against another company you have to register your trademar, how that would be done in somalia/land I dont know. and the other problem is that if you dont actively protect your trademark against dilution you lose it. for example 'kleenex' is commonly used to describe tissue paper even though it is only a specific brand of tissue paper ... the trade mark is so diluted that it is no longer enforceable. and you can have similar/identical company names if there is no risk of the customer getting confused .. or one company unfairly benefiting from the good name established by a competitor through quality and hardworkd. that is why the Apple computer had to settle a lawsuit with Apple music (the company that produced the beatles) , when Apple computers entered the music game (itunes) after that lenghty lecture waan haraaday ... how have you been doing my fellow nomads ?

My understanding is that in civil matters [inheratence,divorce, etc.] the court will allow things to be settled by different laws [sharia, cultural norms, jewish law] to single out sharia violates the american consitutional principle that a state cannot make laws promoting or targetting a religion.

  7. no offence intendedm but I assumed that carmelo was a xalimo until I read NGs response. my assumption was purely based on the topic of discussion. waryaa carmelo it is much easier sxb, when I lived in hargeisa as a bachelor .. gabdhaha deriska used to clean my room and bring a nice home cooked meal at leat 2 or 3 times a week, eventhough I had a standing appointemnt with 'naag ka roon' I used to leave the key to my room under a big rock outside and I never knew, who cleaned my room most of the time .. very nice and hospitable girls, ilaahay ha daayee. one of them used to wash my clothes every jimce ... waxba kaama rabaan, salaanta badi uun.

I think this is a clever marketing exercise which keith is in on. how something like "MSNBC has integrity, has standars .. we even suspended our top guy over ethical journalistic principles .... unlike a certain cable news company we all know [faux]" .. after a few weeks/days off keith comes back "chastised" apologies to viewers and his network. and MSNBC comes out smelling like roses .. after their horrible "lean forward" i.e bend over promotions.

I find it distasteful and a sign of desperation. this the textbook definition of gratuitous nudity. the content of the song had absolutely nothing to do with naked women .. they were just props thrown in there to entice horny teenagers to buy this music. even dim wit rappers when they include half naked women in their music videos have at least something in the lyrics referring to said woman. I find this to be complete garbage.
  12. just to add my little bit. you do realize this ruling was in favour of the women involved in this case and againts the man ? if you read the article a two things will become clear 1. The man was ruled againts becaue he hit his wife in the mouth and left bruises 2. It was also ruled he could not touch his daughter at all. this ruling protects women from ignorant husbands who go too far .. yet every xalimo who has posted in this thread so far has not noticed this aspect

C&H walaal I dont think it is as black/white as you make it out to be. sometimes their are rulings,guidlines in the religion that might not conform to your personal tastes but substituting your personal preferences is not the solution. on this issue, it is clear that harming your wife and children is not permisable in general, and if punishment/discipline is warranted the quran and the hadith of the prophet lay out clear guidlines. there are multiple steps that come before that, for example do not share her bed, etc. and physical discipline as a last resort .. and in this last resort there are still rules to follow: 1. do not hit her/them so hard as to leave marks 2. dont hit her/them in the face. In one of the hadith of the prophet P.B.U.H he said you are like sheperds and each one of you is responsible for his herd. the man/husband has a greater responisbility for his family on his shoulders. in a perfect world it would never happen. but no man is like the prophet and no woman is like the wives of the prophet.
  14. maybe this was a cost saving measure. it is economies of scale scale in action hadii dhinac laga eego. if both weddings are held together the number of guest may increase by a bit, but he saves the cost of the venue/2, food/2 etc. and if he can negotiate the mahar as a wholesal then he saves even more. haduu hal guri dajiyoana he saves on rent ... this man is onto something .. take notes gents

I was commenting on the legal ruling not my opinion, these days you cannot beat your kids waaba the wife. it is the last resort form of discipline and for a mature person it causes more harm than good .. because even if you are obeyed it is out of pure fear and not out of respect. even for kids it needs a balance, too much and it loses the affect of detering bad behavoir as they become almost immune to the pain. not enough edab darada ku badanaysa. so beat your kids, but not too much

I see no problem with this ruling, it echoes the advice of the Prophet P.B.U.H when you are discipling your wife or your child do not hit them in the face and do not hit so hard that you leave a mark. The wife suffered injuries to her lower lip and teeth, and the daughter had bruises on her right hand and right knee. The court ruled that the bruises were evidence that the father had abused his Sharia right The court found for the wife and the daughter because this kind of beating falls outside of what is permissable. it is ammusing to see how the media sensationalize this issue .. by referring to innovative methods used to torture people without leaving a mark . in one article I read about hitting people with a sack of oranges to cause internal injuries etc.
  18. it is amazing the range of applications possible on these phones. if you stop to think about what phones can do these days and imagine your first mobile phone and it how it stacks up. my first phone was a nokia 3XXX can remember the model .. but i once dropped it on my toe and hurt like hell. now I have a phone that I use to remotely control my home computer, and I have softwar based remote starter for my car on my phone that I can start from anywhere. my work phone is tied into my company network .. I can do about 50% of my work from it without showing at the office.

I watched the interview of the somali photographer who took the picture and he explained that it was the meeting agenda being handed outside the entrance by muslim somali yout .. and he even provided the intervwer a copy of the agenda. yes, the photos look damning .. but dont you find it strange that .. people who were attending to leave islam show up to this place wearing hijabs and even excuse themselves during the event to go pray maghrib and re-join.

I listened to interview giving by a sheikh who attended. the only prayer involved was when they excused themselves and prayed maghrib and then re-joined the event. these people did nothing wrong .. it was an event for the religous leaders of the community who inhabit the same nehigberhood and they were there to discuss issues that concerned them that had nothing to do with religion. I watched the somtv interview .. eventhough the inrerviewer was a first class dayuus ... it becomes clear these people are being maligned. I dont think the location is a big deal .. last eid the muslim community rented out a church to pray eid in .. we covered up all the statues and we used the hall for eid prayers.
