How can the country be governed and the national agenda be implemented if he keeps replacing ministers?

 

 

what was the reason for the cabinet reshuffle the country is progressing security and economy are improving significant . Alshabaab are on the Run . Federal states in south are completed .

The Prime Minister is becoming obstacle to the Government policy to implement vision 2016 - The man is power tripping he is becoming selfish power hungry preparing for 2016 to get meaning position or run for President . The Prime Minister is directly igniting feud and set back by targeting President close circle . he will end up losing bad .

Article 90: The Responsibilities and Powers of the

President of the Federal Republic of Somalia

 

• Head of state powers

 

The powers and responsibilities of the President of the Federal Republic of Somalia

are to:

 

a. Declare a state of emergency and war in accordance with the law;

 

b. Serve as Commander in Chief of the Armed Forces;

 

c. Appoint and dismiss the Commanders of the Forces at the Federal Government

Level on the recommendation by the Council of Ministers;

 

d. Appoint the Prime Minister, and to dissolve the Federal Government if it does

not get the required vote of confidence from the House of the People of the

Federal Parliament by a simple majority (50%+1);

 

e. Dismiss ministers, state ministers and deputy ministers on the recommendation

of the Prime Minister;

 

f. Sign draft laws passed by the Federal Parliament in order to bring them into law;

 

g. Open the House of the People of the Federal Parliament;

 

h. Hold an annual session with the House of the People of the Federal Parliament;

 

i. Address the House of the People of the Federal Parliament at any other time;

 

j. Appoint the chairman of the Constitutional Court, the High Court, and other

judges at the Federal Government Level in accordance with the

recommendation of the Judicial Service Commission;

 

k. Appoint senior Federal Government officials and the heads of the Federal

Government Institutions on the recommendation of the Council of Ministers;

 

l. Appoint ambassadors and high commissions on the recommendation of the

Council of Ministers;

 

m. Receive foreign diplomats and consuls;

 

n. Confer State Honors on the recommendation of the Council of Ministers;

 

o. Dissolve the House of the People of the Federal Parliament when its term

expires, thereby prompting new elections;

 

p. Pardon offenders and commute sentences on the recommendation of the

Judicial Service Commission;

 

q. Sign international treaties proposed by the Council of Ministers and approved

by the House of the People of the Federal Parliament.

The constitution is clear. The prime minister has the power to dismiss and reshuffle his cabinet as he pleases.

 

All Culusow can do is make noise now--only to be silenced by the constitution.

Thank you che. As i said earlier this was well within the powers of the PM as the head of the Government and all the President has done is look foolish, childish and un-statesman.

 

He cant do anything about the new reshuffle and the PM will more than likely win this argument outright. In doing so, the President will loose all credibility and power will re-shift to PM. He will become a lame duck president . I am afraid he shot himself in the foot. You pick the battles you can win. Odeyga dagaal uusan ka bixi karin madaxa loo gashey .

Its not the minister's job to go and treat the animals , the same way it wasnt a pre-requisite for farah abdulqadir to be a law expert prior to taking up the position of minister of constitution. What we have here is a president who wants to be the head of state. And head of government at the same time!

 

If he wants to be the one that appoints the cabinet , he should resign as head of state and hope that the new head of state appoints him as PM.

 

As it stands his statement last night was illegal and without a doubt unconstitutional.

 

The PM on the other hand exercised his constitutional powers. One could argue that it was premature but thats all you could argue with. PM's all over the world with similar constititional powers exercise them regularly. You are defending the undefendable using spin which is quite frankly below par and boring. At least lie to us nicely!! Put your thinking cap on.

Presidential Powers:

 

(e) Dismiss ministers, state ministers and deputy ministers on the recommendation of the Prime

Minister;

 

(k)--Appoint senior Federal Government officials and the heads of the Federal Government Institutions on the recommendation of the Council of Ministers;

 

Council of Ministers Powers:

 

(g) Appoint and dismiss senior public officials;

(h) Propose the appointment or dismissal of ambassadors, consuls and diplomats;

 

 

Prime Ministers powers:

 

(b) Appoint and dismiss members of the Council of Ministers;

 

 

The PM just tried to pull off a major coup.

 

Although, the powers to appoint and dismiss are reserved to him. They are not exclusive to him because they also give the president the power to "appoint" and "dismiss" ministers "on the recommendation" of the council of ministers.

 

See the confusion? If the PM can appoint and dismiss the ministers then why "recommend" it to the president unless he has a say in it?

 

PM STRATEGY:

 

1) The PM wants to expand his powers. This is the perfect time to do it against a weakened president.

 

His signing of Puntland agreement was clear that a political battle was coming. And he aligned himself square with his kinfolk.

 

2) The puntland agreement regarding Mudug is crucial. Both sides have a case as to the legality of Puntland + North Mudug OR Mudug (partially controlled by puntland) + Galgaduud because the constitution requires that 2 or more states join and not 1.5 states.

 

The implication is tremendous because it means the weakening of Puntland or Central state. In other words, either HG land or MJ land will be gerrymandered and weakened in the process.

 

But resolving this issue requires constitutional analysis. That is why the Minister of constitutional Affairs CANNOT be Farah Abdulqadir in the eyes of the PM.

 

Why the President Can't Let it Go:

 

If the president lets it go, the PM has a strong case that the powers to appoint and dismiss are EXCLUSIVE to him without consultation with the president.

 

An even stronger case considering that he fired Sanbaloolshe and the president didn't say anything.

 

If the President keeps Farah Abdulqadir as the Minister of Const. Affairs, he wins the constitutional fight. And if you win the constitutional fight, you win EVERYTHING.

If i may come back to a few points you made-

 

You are right, presidential powers includes appointing and firing ministers but only after receiving recommendation from PM, whereas the PM has full powers to fire or appoint without needing any further authorisation.

In this case,PM comes with the changes and the role of the president is similar to a constitutional monarch and he ascends the bill or recomendation passed to him. Let me be clear , he has other powers but on this issue that is his role.

 

The PM has NOT fired or appointed NEW ministers, he simply moved them around and doesnt need any permission to do so.

 

If i come to the state formation-

Again the constitution says that "new" states being formed must be 2 or more provinces pre-1991 provinces and it also clearly says existing states at the time of ratifying the constitution are excempt from intereference in their territorial integrity.

 

So, that means Puntland is out of bounds and the first agreement signed in Xamar was on the wrong side of the constitution.

 

As far as the new state being formed is concerned, unless people are looking to create mayhem, why cant it be galgaduud, hiiraan, shabeelada dhexe and half of mudug,

 

Alternatively if you have an issue with the division of mudug, why not add the remainder of mudug to Puntland, a state that has been in existence for 16 yrs and then have galgaduud, hiiraan and shabelada dhexe as a state.

 

Again, that would be the logical solution but of course, that is not what they want is it?....
