Pakistan foreign minister disqualified by court for holding UAE work permit

A three-member special bench of the Islamabad High Court announced the verdict on a petition filed by Pakistan Tehreek-e-Insaf (PTI) leader Usman Dar, seeking disqualification of the foreign minister under Article 62 and 63 of the Constitution for holding an Iqama (work permit) of the UAE.

Pakistan's Foreign Minister Khawaja Asif was today disqualified as a member of the parliament by the high court here for concealing details of his UAE work permit while contesting elections in 2013.

A three-member special bench of the Islamabad High Court announced the verdict on a petition filed by Pakistan Tehreek-e-Insaf (PTI) leader Usman Dar, seeking disqualification of the foreign minister under Article 62 and 63 of the Constitution for holding an Iqama (work permit) of the UAE.

Dar, who lost election against Asif in 2013, had challenged the qualification of Asif, 68, as the member of parliament for not declaring his job and salary while contesting the polls.

 
 

The bench unanimously ruled that Asif was not “truthful” and “honest”.

 
 

Asif will be unable to hold public or party office after the verdict.

The PTI leader had urged the court to disqualify Asif, stating that the Supreme Court has already disqualified Prime Minister Nawaz Sharif last year for having an 'Iqama' of working in the company of his sons and not declaring his "receivable salary".

The petitioner alleged that Asif had Unlimited Term Employment Contract with International Mechanical and Electrical Co (IMECO). He was hired as full-time employee in July, 2011 and held various positions.

He claimed that Asif under the contract was to receive a monthly basic salary of AED 35,000 along with a monthly allowance of AED 15,000, which he did not declare.

During the hearing, Asif had submitted a letter from the company that he was not full time employee and only worked as a consultant whose presence was not needed in the UAE, where the company is based.

The bench, comprising Justice Athar Minallah, Justice Aamer Farooq and Justice Mohsin Akhtar Kayani, had reserved the verdict on April 10.

Asif is one of top leaders of ruling Pakistan Muslims League-Nawaz and his disqualification is considered a huge blow to the party ahead of election scheduled to be held after June.image.png.20e9dd4b7266384ef1d439677e1fc541.png

It is actually UAE that has exposed him, after they could not longer get more from him, the main issue is GWADAR port, and silk road.

ISLAMABAD: In another blow to PML-N, Foreign Minister Khawaja Asif has been disqualified by the Islamabad High Court (IHC) on the basis of holding an Abu Dhabi Iqama (work permit).

On April 10, an IHC larger bench had reserved its judgment in a matter where a Pakistan Tehreek-e-Insaf (PTI) leader Usman Dar sought disqualification of the federal minister on the basis of work permit.

Justice Athar Minallah heading the three-member bench,  read out the  order disqualifying the foreign minister under Article 62(1)(f). Justice Aamer Farooq and Justice Mohsin Akhtar Kayani were the other members of the  bench.

"We declare that the Respondent was not qualified to contest the General Election of 2013 from NA 110 as he did not fulfill the conditions described under Article 62(1)(f) of the Constitution, read with section 99(1)(f) of the Act of 197," the judgement stated.

Pakistan Tehreek-e-Insaf’s Usman Dar filed this petition seeking disqualification of Asif for concealing the facts that he was an Iqama holder, legal advisor of a company in UAE and his recent labour card was issued on June 29, 2017. Khawaja Asif on the other hand took a view that he concealed nothing and his Iqama was declared in the nomination paper.

The petitioner adopted that Supreme Court on July 28 disqualified former Prime Minister Mian Nawaz Sharif for possessing an ‘Iqama’ and Khawaja Asif can also be disqualified on similar grounds.

The bench had reserved the verdict, however, it allowed the parties to submit additional documents if they have. Khawaja Asif on April 16 submitted a letter of an Abu Dhabi company where he is employed.

After the verdict, joyous Dar dedicated his victory to the people of Sialkot and PTI Chairman Imran Khan. "I had decided to throw Kh Asif out of the parliament and today I have done this," he further said.

As per the letter presented in the court, Khawaja Asif’s job with International Mechanical & Electrical Co. WLL. is quite flexible and there are no conditions on him to stay there in Abu Dhabi. The company can seek his legal advice via telephone or whenever he comes to UAE. Managing Director of the company, Elias Salloum, has expressed that he is ready to come before any court in Pakistan.

After the order, Kh Asif told Hamid Mir that he would challenge  the verdict in the apex court.  "I am hopeful of getting relief from the SC," said the minister.

'Fixed match'

While PTI was overjoyed, Maryam Nawaz on the other hand said Khawaja Asif was disqualified in a “fixed match”.

“Whoever you are certain you cannot defeat in a fair match, you get them disqualified through a fixed match,” she tweeted.

'Iqama used to shield corruption'

Pakistan Tehreek-e-Insaf Chairman Imran Khan said that Khawaja Asif has been disqualified for 'using iqama to shield corruption & indulge in money laundering'.

In  his response on the disqualification, the PTI chief said: "Another darbari of the Godfather disqualified on the same pattern - using iqama to shield corruption & indulge in money laundering - as well as being guilty of brazen conflict of interest".

"Allah Al Haq hai - Kh Asif targeted SKMTH & has been publicly humiliated here & abroad," he tweeted.

THrough the Panama papers, they destroyed former prime minister Nawaz Sharif, the most successful Pakistani prime minister in recent years and the architect of Pakistan China Economic Corridor --CPEC.

The Chinese are spending $46 billion dollars to built modern port, railways and highways to connect northern China a to the Persian gulf.

If there is war or blockade in South China Sea, the Chinese trade in the pacific will halt. By coming to Gwadar port, they cutting the travel time for thousands kilometers of see travel. Both India, UAE, and America want to stop the CPEC project. 

As I said, this colonial post will destroy many more countries.

Furthermore, an insurgency  in Balochistan fueled by India and foreign intelligence is aimed to target the development and slow down the project. 

Even Trump openly attacked Pakistan blaming  her of the failed Afghanistan war. I have no doubt that the colonial outpost of UAE is probably sending cash to destabilize Pakistan.

The UAE had involved more than six or seven coups in Africa and middle east since 2011. They are trying to destroy some countries like Yemen, Libya and Syria, while targeting Somalia, Tunisia, Pakistan, Turkey and others through covert and economic destabilization. They want to fragment Somalia, Yemen, Libya . In Libya they are supporting the Benghazi based separatist led by general Hafter. In Yemen , they armed and created the South Yemen separatist army, and they want to build base in Berbera which will bomb Mogadishu, Kismayo and other Somali towns . This is not crazy idea from Galbeedi but it could happen.

We must kick them out from Puntlland and other places in order to survive, and eventually replace for whatever services they were providing in these regions.

100% agree with you, have lots of Pakistani co-workers, and some friends, They are extremely angry and hate what UAE is doing to their country.

But I think they cannot stop Pakistan, they are more dangerous to us, since we have  shameless, mentally challenged, narrow-minded, cannot see big pic, and corrupted leaders, and as UAE minister said, ""most SOMALI leaders have a price,  and we can afford it", we have a problem.

This  Pakistani minster was being paid over $20K+ per month for almost 8 years by UAE, and when he was no use any longer, exposed.

Gaas and Madoobe are their latest purchases and as reported widely they were part of the summer sale with very cheap price tags xD

Indeed the Arabs bought Gaas and Madoobe together as part of a "buy one get the other free" deal:D

If the UAE wants to give development money to Somaliland or Puntland or Jubaland, to help these governments economically and boost local security against terrorism, every Somali should support. What Kheyre and Farmaajo think or personally feel is irreverent. We Somalis need to be practical and start making sense. We don't have a Somali central government that is able to share national revenue with regional governments. Until that day arrives, every Dowlad-Goboleed should cover its budget gap with money it begs from outside friends. Particularly, I don't see a problem with the UAE continuing to train Puntland marine forces the same way it was doing for years. It is a great project.

What we don't want, however,  is for the UAE to take over our ports and profit from them without permission from the federal government. I also hope we don't ever get to a situation where the UAE is openly sabotaging active Somali development projects the same it is trying to kill the Pakistani port.

I think the economic needs of Puntland could be taken care off without UAE. As we mentioned before, the UAE is a grave threat to the sovereignty of Somalia and the maintenance of that sovereignty and the existence of the nation supersedes everything.

The issue of training and salary for Puntland security must be addressed by the federal government as they address the security issues of MOgadishu. The interest of Somalia and Puntland are identical. If I tell you that this entity is trying to finish off the Somali state or cut in half, you must not ignore these dangers. 

We see everyday the gathering of the storm from the gulf. They are killing and selling their own brothers throughout the middle east and making every little quarrel like a dangerous for for the region. They want to remain the only peaceful and prosperous  island in the Red sea and the gulf while destroying competition.

Look in Korea.  Both the South and the North have agreed to unite after seeing the threat to their nations and the stability of both South and North. Yet, for the gulf it is a throat cut business where  one brother must eliminate the other. Junior king Salmaan is detaining and oppressing his own cousins and brothers in  order to rule fifty years. Somalia for them is a playground.

      What will be the place and role of Horn of Africa countries?
      The ARABNATO point man in the horn will be none other than Eritrea's Isayas. Who will be the members. Somalia again since is weak will pulled in both directions. ARABNATO maybe directed against Iran, but it is also against Turkey. It will reduce Turkey position dramatically. The Egyptians are hoping will be foot soldiers and recipients of the money.
      Since Saudi Arabia is not suitable to be base and UAE has no room, most likely Eritrea will compete for this base as well.
      This is very active project now and urgent.
