Joint Declaration By The Elders of Maakhir & KHaatumo States of Northern Somalia

 

 

Memorandum on the Dialogue between Somalia & Somaliland Submitted to TFG Delegation by the Elders of Maakhir & KHaatumo Region of Northern Somalia

 

 

20th June 2012

 

Memorandum on the Dialogue between Somalia & Somaliland

 

We the elders and representatives of Maakhir and KHaatumo wish to bring to the attention of the TFG Delegation our views on the dialogue between Somalia and Somaliland and the road map, which are as follows:

 

Historical Background:

 

1. The territories that became to be known as British Somaliland Protectorate in late 19th century was inhabited by Somalis, which were traditionally divided into clans. Each clan was separate and independent from the others. This was observed by Sir Richard Burton when he visited, in 1855, the Somali territories, facing the Gulf of Aden. He mentioned in his book “First Footsteps in East Africa” that the frontier between the Maakhir and the Somaliland is denoted by piles of rough stones and violation of territorial rights was followed by war.

 

2. The clans separately and independently entered into agreement with the British Government. The Maakhir clan entered into a treaty with the British Government on 27th January, 1886. The Treaty was ratified by the British Government on 15th May, 1886. Article 1 of the Treaty said, “The British Government, in compliance with the wish of the undersigned Elders of the Maakhir, undertakes to extend to them and to the territories under their authority and jurisdiction the gracious favour and protection of Her Majesty the Queen-Empress.”

 

3. Thus the Maakhir clan, among others, maintained its connections with the British Government separately from other clans on the basis of the treaty signed between the United Kingdom Government and the Maakhir that recognised its area to be a separate territory. The Treaties, including that with the Maakhir, which the British Government concluded with the clans, did not create a unitary state. Therefore British Somaliland Protectorate was not a unitary state but an umbrella entity for administering the territories of these separate and independent clans on the basis of the Treaties.

 

Facts relating to the Union between UN Trusteeship of Somalia and British Somaliland Protectorate:

 

1. In December, 1959, the General Assembly of the United Nations adopted a resolution that UN Trusteeship of Somalia, under Italian administration, should become independent on 1st July, 1960.

 

2. The Legislative Council of British Somaliland Protectorate met on 6th April, 1960 and with the unanimous support of all the elected members passed the following Resolution:

 

“That it is the opinion of this house that practical steps should be taken…for the immediate unification of the protectorate and Somalia (UN Trusteeship)…that the date of independence and unification with Somalia must be 1st July, 1960, the date when Somalia will attain its full freedom.”

 

3. As a result of this Resolution, a Conference was held in the Colonial Office, London, on 2nd May, 1960. The Somaliland Ministerial Delegation led by the Minister of Local Government & Leader of Government Business, Mohamed Ibrahim Egal, confirmed their desire to achieve independence and unite with Somalia when that country became independent on 1st July, 1960.

 

4. The British Secretary of State for the Colonies, Iain Macleod, referred to the treaties that the British Government had with the clans. He asked for some form of proof that the elders and the authorities of the clans were in agreement with the demand for independence and union with the UN Trusteeship of Somalia.

 

5. The Council of Elders of British Somaliland Protectorate met on 24th May, 1960 and endorsed the policy of independence and union with Trusteeship of Somalia.

 

6. The Royal Proclamation Terminating Her Majesty’s Protection dated 23rd June, 1960 begins with the words; “Whereas the Territories in Africa known as the Somaliland Protectorate are under our protection; our protection over the territories known as the Somaliland Protectorate shall cease… ” and this proves again that Somaliland Protectorate was not a centralised unitary state.

 

7. Somaliland Protectorate became independent on 26th June,1960 and on June 27th,1960, the Legislative Assembly of Somaliland passed the Law of Union between Somaliland and trusteeship of Somalia, which read:

“The State of Somaliland and the State of Somalia do hereby unite and shall forever remain united in a new, independent, democratic, unitary republic the name whereof shall be the SOMALI REPUBLIC.”

 

8. The Union of Somaliland and Somalia Law No.1 was passed on 1st July, 1960. It was later, after the referendum on the constitution in 1961, was adopted as the Law of the Act of the Union.

 

9. United Nations General Assembly resolution 1479 of September 20, 1960, called “Admission of Somali Republic to membership in the United Nations” and stated that it, “…decides to admit the Republic of Somalia to membership in United Nations.” Thus Somali Republic gained international recognition and legitimacy as a subject international law. All the previous states such as Trusteeship of Somalia and Somaliland which formed Somali Republic no longer exist since that moment.

 

1. The Dialogue

 

* We support the territorial integrity, sovereignty, political independence and unity of Somalia.

 

* The dialogue between Somalia & Somaliland should be conducted within the framework of the territorial integrity, sovereignty, political independence and unity of Somalia.

 

* The dialogue should be on the basis that Somaliland is a regional state of Somalia like Puntland and Gulmudug and NOT as an independent state.

 

* Somaliland only represents the Northwest clan and cannot represent the Maakhir, Awdal & KHaatumo even though its delegation may include members of these clans.

 

* The TFG delegation should have separate dialogue with representatives of other non-Somaliland clans (Maakhir, Khaatumo, and Awdal), who are independent of Somaliland, so as to save guard their political, economic, security and social interests. Similarly they should be represented in the proposed meeting in Qatar.

 

* The dialogue should be confined to the integration of Somaliland to the road map.

 

* If concessions are accorded to Somaliland clan, then equal concessions should also be extended to the other four non-Somaliland clans to be equally distributed between them.

 

We hope that our views will be given serious consideration.

What's good for the goose is good for the gander. If the above mentioned people are clanist so are you sir. Somalis have the tendency to point finger at others while they totaly and shamelessly disregard their shortcomings, lie inorder to further the interest of few to the detrimental safety of all. I believe no one should be forced to join a counrty or sociaty he or she does not wish to be part of. It's time for all somalis to be honest to one another ( I doubt that will ever happen) or accept the consequences. Once and for all stop this pointless argument over who is first the chicken or the egg issue. Britian left Somalis in disarray, treat them like animals and left them half dead for what's left of Somalia, and they inturn treated each other worse, and here they all claim to have played no part of all the problems that occured the last 52 years and are still doing it. I have come to realized Somalis became cowards, faithless and godless. If You can not coexist leave eachother alone in peace because like it says ( Wax badso intaad is leedahay yeysan waxla'aani kugu dhicin). While you all seek clan hegemony don't loose what you already have. Say alhamdulillahi if you believe in ASWT and protect your two mile square forget about what you think you inhereted from a foriegner AKA UK or keep it up and when you burn don't plame anyone else but your self. All in all, we shall soon see what the TFG position is on this issue. Hence, that will tell us all we needed to know as to the color of their argument when it comes to the talks between the two sides.

 

Talk about the pot calling the kettle black, Odweyne you are full of qabyaalad, hypocrisy and hatred. Don't be mad if Other clans & regions don't want to join your clan-project (snm/Somaliland). Remember respect is 2-way street. If you want others to respect and recognize your clan-project (snm/Somaliland), You should show respect to other Somali clans/regions (Awdal, Maakhir, Khaatumo, Puntland, Galmudug, Banadir, Juba, etc)

Well Said Brother Reer Banadir, we need more somali patriots like you. I agree with you It's time for all somalis to be honest to one another, the people of Northwest (SL) should have the right to secede from Somalia, and create their own independent state. Likewise, the people of Khaatumo, Maakhir, and Awdal should have the right to remain an integral part of United Somalia, and create their own autonomous regional state in their ancestral lands inside Somalia.

In 1855 Somaliland and Maakhir?? What kind of books Afweyne loyalist read? so called Maakhir clan wether they signed a seprate treaties or a joint one it bares nothing to today's somaliland bounderies, the eastern boundries were demarcated in 1931 and both so called SSC and Maakhir agreed that they were British subjects and not Italian subject and thus the bounderies were born, a boundries that were mid-wifed by the same whining bunch now.

 

Somaliland's boundries would not change because Maakhiris and the horse clan of Laas Caanood love to be joined to Xamar, if you want Xamar you go to Xamar, Xamar will not come and cross somaliland border and give you a big union wet moochie.

The idea of talks raised its ugly head all the way back in Feb of this year, yet all these guys (and the Imam) are scrambling at the last minute and writing silly letters of complaints now! :D

 

They should have worked on this issue from the minute they heard it was about to take place. They should have sweat talked Sheikh Sharif, Cabdualwali or Sheikh Xasan much earlier. They should have used to the carrot of the "votes" of their own people to tempt any of these "presidential" candidates into fighting for their cause.

 

It's a bit too late for letters and complaints now. The talks have been agreed to take place between TWO sides and there is an implied acceptance that SL represents all of these letter writers (except the Imam of course). Talk about horse trading when the horse has already bolted. :D

What arrogant, rude, hateful, fascist, ignorant comment. To say people should vacate and uproot themselves because you believe a non Somalis, non Africans non Muslims once over 100 yrs ago came to the norther shores made illegal encroachment, never honored one treaty they signed with the natives and you want the people respect that treaty and abide by because you feel someone committed crime against your family (mind you that that criminal was committed against all Somalis in that country, not that you would care). HHMM . What would you say if someone says since you don't like to be part of Somalia (mind you the union was done by Somalis Africans and Muslims wish is more legit) you and your kind should leave all Somali territory what would your reaction be? Mr. jungle like your nick name people don't live in the jungle they settle their argument without resorting to ethnic cleansing of those oppose to them. There's an international law against that don't end up of the receiving end of that law. Remember that those that you think are your friend will not hesitate to send you to Guantanamo bay once your need expires, and like I said Wax badso intaad is leedahay, wax la'aani yeysan kugu dhicin. No one would leave their land for you without a fight and when pullets start flying you have no idea who will get chased. Live in peace and let others live in peace or don't cry later if you choose a war.

Liibaan, do you think a Somali politician from the TFG would want to deal with Khatumo, Makhir, Awdal, Zeylac, and 10 SNM sub-clans seperately or rather deal with one Somaliland representing them all?

 

If I was a politicians I would rather deal with one politician or platform, then clan representetive. :D

Which colonial Somaliland you talking about? French Somaliland, British Somaliland, Italian Somaliland, NFD Somaliland, Western Somaliland. British Somaliland Colony ceased to exist on June 26, 1960. And Italian Somaliland Colony ceased to exist July 01, 1960.

 

 

KHaatumo People were always against British Somaliland Colonial Maps, KHaatumo people never agreed to be part of Somaliland's colonial map. Warlord Siilaanyo as the leader of snm/Somaliland clan faction is clan representative.

 

TFG already recognized KHaatumo State of Somalia. Sheikh Shariif said he will mediate to solve the conflict between KHaatumo and snm/Somaliland. Also, Sh Shariif said he is willing to mediate between KHaatumo State and Puntland.
