IL CAPO Posted July 9, 2004 London - A 100-year-old retired English butcher walked free from court on Thursday after a judge ruled that he had slit his disabled wife's throat in "an act of love". Bernard Heginbotham pleaded guilty to the manslaughter of his wife Ida, 87, after he learnt she was to be moved from the nursing where she was being cared for. When police arrived to arrest Heginbotham the same day, they found he had attempted suicide. Mrs Heginbotham had gone through several such moves, and prosecutor Hilary Banks acknowledged her husband had felt increasing distress. "He admitted that he went to the home with a weapon and injured his wife which resulted in her death. He didn't want his wife to be moved again and didn't think she was going to receive the care he wanted her to have," Banks told the court. Preston Crown Court in the northwestern county of Lancashire handed down a 12-month community rehabilitation order on Heginbotham, who sobbed as the sentence was read out. During the trial the former butcher said he had enjoyed 67 years of "joyous" marriage with is wife, during which they raised six children. Ida Heginbotham was found by care home staff with a single knife wound to the throat after the daily visit from her husband on April 1 this year. She had become dependent on her husband after being hurt in several falls. As her condition deteriorated she needed specialist care and was moved between numerous care homes. Passing sentence, the court said Heginbotham had acted in desperation "in an effort to end her suffering while you were under intolerable pressure. "It was in truth an act of love and I have no doubt you suffered a medical disorder at the time and the responsibility which you bear is substantially reduced," Judge Leveson said. He expressed concern at the way Ida Heginbotham had been moved between homes. There has been repeated criticism in England and Wales of state-provided care for the aged.
