One suspect, who was caught on a CCTV camera and accused of being involved in the Westgate terror attack, has been freed by a Milimani court.

The man was captured by surveillance cameras in a bank allegedly paying for the car that was used in the assault on the mall.

Trial magistrate Francis Andayi stated that according to evidence presented in court, Adan Dheq wasn’t involved in the 2013 attack.

Three of his other co-accused were, however, found with a case to answer.

Ahmed Abdi, Liban Omar, and Hussein Mustafa will be expected back in court on January 21 when the case will be mentioned.

The attack carried out on September 21, 2013, in the upscale Nairobi mall left 67 dead and several others wounded.

Their trial started in 2014 over the mall siege that was claimed by the Somalia-based terror group Al-Shabaab.

In December 2018, the Director of Public Prosecutions Noordin Haji narrated his rough experience during the siege.

Haji was then a director at the National Intelligence Service (NIS) in charge of counter-terrorism measures and had visited the mall to purchase gifts for his colleagues.

The gifted intelligence officer was fearful of his life because he thought he was a target. His cover as a spy had been blown after appearing in a KTN documentary just a few weeks prior to the invasion of the mall.
