Somalia: Bay region admin ‘violates federal constitution’: Baidoa MPs

MOGADISHU, Somalia Mar 28, 2013 (Garowe Online)Somali lawmakers from the country’s Bay and Bakool regions have rejected President Hassan Sheikh Mohamud’s newly appointed regional governor as “unconstitutional” in a move that intensifies the political dispute in Mogadishu, Garowe Online reports.

 

A group of Somali MPs from Bay and Bakool regions, all of who belong to the ****** clan, held a press conference Thursday in Mogadishu.

The lawmakers include MP Aden Mohamed Saransoor, MP Osman Libah and MP Hassan Moallim Hussein.

 

“As you all know, a decree dated 4 February 2013 issued from the highest government offices in Somalia appointed a new governor of Bay region and this appointment violates Article 46 and Article 51, of the Somali Federal Constitution,” read a written statement issued by the MPs.

 

Continuing, the statement read: “This new administration for Bay region appointed by decree is a danger to local communities, since the legally elected administration has been removed.”

 

The Somali MPs from Bay and Bakool regions requested Somali government leaders to “adhere to the law and constitution” of Somalia.

 

Earlier this month, parliament Speaker Mohamed Osman Jawari travelled to Baidoa, capital of Bay region, to resolve a political dispute that erupted after President Hassan appointed a regional governor by presidential decree.

 

On August 1, 2012, a National Constituent Assembly adopted the Somali Federal Constitution, which guarantees the voluntary merger of two or more regions of Somalia’s 18 administrative regions.

 

President Hassan has demanded to appoint regional governors for Hiran, Bay, and Lower Jubba regions.

 

The president has appointed new governors of Hiran and Bay regions, and it is the first time that Somali MPs from the above mentioned regions have voiced their concerns regarding President Hassan’s unilateral decision.

 

In the southern port of Kismayo, capital of Lower Jubba region, President Hassan has rejected a convention held by local communities to establish Jubaland state administration and the president has demanded that he appoint a regional governor, but Kismayo leaders have rejected President Hassan’s pressure as unconstitutional.

The PM's from are right, the government has no power to nominate local and regional officials. This is power abuse, dictatorial, illegal and unconstitutional.

Baidoa was making progress and had done a lot of avert the dangers of insecurity and Alshabaab, however the government's rush, ill considered and unconstitutional move made the situation worse. A lot of the progress made now had started to regress and people are scared because of the insecurity and the Ethiopian forces aren't sure to be staying there, it's a mess what this SFG has done.

I think hassan wants to Kill clan federalism and unite bay bakool gedo and the 2 jubbas and lower shabelle and middle shabelle. Its still federalism just a different flavor.

Its in a pocket waryaa, mideeda kale waxaa kahoraysa ayaa dagaysanayaa Madaxwaynahay iyo RW ayaaba ladhageesaneed iyagana sharciga kutumanaayaan. This is the the wild wild east of Mogadishu - that's why the MP's from are making themselves heard.

 

Basically Jawari ayaa deal lalagalay to run the show in Bay and Bakool, that's why the MP's are angry about the whole thing.

Those xildhibaano have sour mouth. Ciil ayaa haayo, some for personal reasons. Why is Saransoor against this? Because the new guddoomiye ku xigeen of gobolka Baay waxaa loo magacaabay Shiine Macalin Nuuroow, an arch-opponent of Saransoor, but very close clanmate. They had a protracted challenge in the xildhibaan seat Saransoor now holds. Malaaqa ayaa gar bixiye, his decision siding with Saransoor. Shiine refused to concede, oo heer gacan ka hadal gaari rabtay.

 

Fowsiyo Maxamed Sheekh, Cismaan Libaax and others are not satisfied with this because, to them, guddoomiye ku xigeenka cusub's clan does not deserve to be the deputy post because his clan resides in Bakool, according to them. Marka iyagoo kasoo jeedo gobolka Baay, gaar ahaan inta u dhaxeyso Baydhabo iyo Buurhakabo, should at least have guddoomiyaha gobolka, if not kan guddoomiye ku xigeenka. Neither happened, hence the mucaaradnimo.

The era of issuing a presidential decree from Villa Somalia is over. Good riddance. I don't know the details of this particular event and I won't pretend I know anything about dynamics with that region. What I do know is that political settlement called for local ownership for all things related to local affairs.

 

How does having locals choose their local leaders a threat to central authority? It beats me!!

 

The issue goes deeper than personal squabbles between politicians from that neck of the wood. At issue is the direction the country is embarking on going forward.

This is the goverments first real test. If the goverment cant excersize its authority now, then it wont be able to yield any leverage in future (regional) conflicts either. It will become a second TNG, subject to the grill of local lords who neither elected by the people themselves.

^^ Carafaat dont worry this government will be a success Hassan culusow and co will find a way to solve this. They have what it takes the only problem is now the Jubbaland issue that needs to be solved. When that is done the goverment can fully govern the country.

Indeed man. Some of the MPs may be doing this for political point scoring as suggested but the medium they are using is legitimate and that that their call of 'appointing regional officials from Mogadishu' as unconstitutional is right.
